§ 46-31. Property owner's duties.

The owner or his designated agent of any property within the city upon which residential, commercial or other types of development are proposed, or are in progress, following August 2, 1995, shall be responsible for taking the necessary action to prevent erosion of the construction site and the resultant accumulation of sediment, debris or other materials upon adjacent property, and such action shall be carried out to the satisfaction of the director of public works or his designee. Such necessary action may consist of the distribution of hay upon the construction site after grading, the placement of sedimentation cloth or geotextile material on the construction site, the placement of hay bales at selected locations, the construction of sedimentation pools and/or any other action considered satisfactory by the director of public works or his designee.
