§ 122-31. Wrecker service.

  • (a)

    When a vehicle has been involved in a collision or accident and is unable to proceed safely, or when the driver of such vehicle is physically unable to drive the vehicle, the police officer investigating the collision or accident shall request the driver of such vehicle to designate a wrecker company to tow the vehicle to an appropriate location.

    (b)

    The investigating police officer shall notify police communications who shall call the designated wrecker company and inform the wrecker company of the collision or accident.

    (c)

    If the driver is physically unable or refuses to designate a wrecker company, the investigating police officer shall notify police communications to select a wrecker company from the rotation list maintained by police communications for nonpreference towing. A nonpreference wrecker is one which is called by a police officer in an instance when the owner/operator of a vehicle to be towed has no special preference for which wrecker company tows the vehicle, is incapable of making a decision, or is not physically present to make a decision relating to the necessity of the towing service.

    (d)

    A response time of not more than 30 minutes shall be required of all wreckers that have been dispatched by the police communications dispatcher. If a wrecker has not arrived at the scene or site of the accident or collision within the 30-minute time limit, the police communications dispatcher shall call the wrecker company and advise such wrecker company that the wrecker service is canceled. The police communications dispatcher shall then select the next wrecker service from the authorized rotation list maintained in the police communications center.

    (e)

    No driver of a wrecker shall remove any wrecked, damaged or disabled vehicle which has been involved in a collision or accident from the place where such collision or accident has occurred, or attach the wrecker to such wrecked, damaged or disabled vehicle until the investigating police officer has completed the investigation. It shall be the duty of the wrecker driver that removes a wrecked, damaged or disabled vehicle from the place where the collision or accident has occurred to clear the street of any debris, parts or glass.
